Can bailiffs take my car if it's on finance?

At a glance

  • On hire purchase (HP) or PCP, the finance company owns the car until the last payment.
  • Bailiffs can only take goods that belong to you, so they should not clamp or remove it.
  • Show the finance agreement to prove it is not yours.
  • If they take it anyway, the finance company or you can make a formal claim to get it back.

Proving the car isn't yours

  • Keep a copy of your finance agreement somewhere easy to reach.
  • Bailiffs can check online whether a car is on finance — ask them to do so.
  • Personal loans are different: if you bought the car outright with a loan, it is yours and could be taken.

Other protections

  • A vehicle you need for work may be protected up to £1,350.
  • A car with a Blue Badge used by a disabled person should not be taken.
  • Contact the bailiff company in writing straight away if your car is clamped wrongly.

Can bailiffs clamp a car on finance?
They should not, because it is not your property. Send them the finance agreement and ask them to remove the clamp.
What if the car is in my partner's name?
Bailiffs should not take goods that belong only to someone else. Keep proof such as the V5C and purchase paperwork.
